Solve Your City Liability Waiver and Release

This Agreement releases certain claims belonging to you arising from your participation in the Adventure, including claims arising from ordinary negligence. Read it carefully before signing.

1 Agreement and Scope

In consideration of permission to participate, I enter into this Liability Waiver and Release ("Agreement"), effective 2026-10-08, with Solve Your City LLC ("Company") in the capacity in which I sign. The adventure covered by this Agreement is [adventure title], a self-guided adventure in [city], [state] ("Adventure").

This Agreement applies to the particular occasion of participation for which it is executed, including a delayed start or a pause and subsequent continuation of that same participation on a different date. It does not cover a separate purchase, a separate grant of permission to participate, another occasion of participation or unrelated activities. It does not release claims arising before I sign.

Participation includes adventure activities and travel between adventure stops, whether I use my own device, share a device or accompany other participants without using a device. I may discontinue participation at any time.

2 Capacity to Sign

Each participant who is eighteen or older must execute this Agreement personally. Each participant under eighteen must have the consent of a parent or legal guardian who personally executes this Agreement for that minor. An organizer or other supervising adult may not sign for another adult or for a minor unless that person is the minor's parent or legal guardian.

3 Acknowledgment and Assumption of Risk

I acknowledge that the Adventure and travel between its stops involve risks. Travel may include walking, driving, cycling, riding as a passenger, public transit or another lawful means of transportation. The Company does not provide or control my transportation. Certain stops require access on foot or by a permitted mobility device.

These risks include falls; uneven or slippery surfaces; road and sidewalk hazards; vehicle collisions; railroad crossings; nearby water; heat, cold, storms and poor lighting; fatigue and illness; the conduct of other persons or animals; theft; equipment failure; and distraction. Maps, GPS and compass information, camera-based features, digital markers and network connections may be inaccurate, delayed or unavailable.

These risks may result in serious injury, disability, death, property damage or loss, medical expenses and lost income.

If I participate as an adult, I voluntarily assume these risks, subject to the limitations in Section 6. If I sign as a parent or legal guardian, I acknowledge these risks in deciding whether and under what conditions the identified minor may participate.

4 Safety and Access

As a participant, I shall select a safe and lawful method of travel and route appropriate to the Adventure, each stop, my abilities and current conditions. I shall comply with applicable traffic, licensing, equipment, parking, pedestrian access and other access requirements.

I shall participate only when walking surfaces, traffic, obstacles and my surroundings are clearly visible. I shall comply with any restriction requiring participation during daylight. Where evening participation is permitted, I shall use adequately lit routes and stops, observe lawful access hours and discontinue participation if lighting, weather or other conditions make continuation unsafe. Permission to participate in the evening is not a representation that a route is safe.

I shall not view or interact with the Adventure while operating a motor vehicle, bicycle, scooter or other transportation device. Before doing so, I shall stop safely outside traffic where stopping is permitted and park any motor vehicle. A passenger may use the Adventure without distracting the driver. When walking, I shall stop in a safe place before viewing or interacting with the screen, remain alert and use lawful crossings. I shall not participate while impaired.

I shall not trespass, cross barriers, disregard signs or closures, climb structures, enter restricted or construction areas, approach dangerous water or ledges, or follow a clue, direction or marker into danger. Current conditions, property rules and lawful restrictions govern regardless of any direction provided through the Adventure.

Building entry is required only where the Adventure expressly identifies an authorized indoor stop. I shall enter only when access is lawful and permitted. Entry onto private property requires the owner's permission and compliance with applicable rules. A clue, map location, route or digital marker does not confer permission to enter.

The Company provides entertainment and does not provide live supervision, childcare or emergency response, or guarantee safe navigation. I remain responsible for my surroundings and shall discontinue participation when conditions are unsafe. In an emergency, I shall contact the appropriate emergency service.

5 Released Parties

"Released Parties" means Solve Your City LLC; its owners, members, investors and affiliates; its partners, sponsors, participating organizations, service providers, contractors, and owners or operators of participating locations; and their respective officers, directors, employees, agents, authorized representatives and volunteers, in each case to the extent involved in providing, supporting, sponsoring, hosting or promoting the Adventure.

These categories include museums, historical societies, nonprofit organizations, municipalities and other governmental entities when acting in a covered capacity in connection with the Adventure. They apply according to each party's covered involvement, whether or not that party is separately named, and only to the extent permitted by law.

The mere mention of a location in a clue, passage across a property or encounter with a person does not establish that person's or entity's involvement as a Released Party. The release applies only to claims arising from the Adventure and the party's covered involvement.

6 Adult Participant Release and Limitations

In my capacity as an adult participant, and to the fullest extent permitted by law, I hereby release the Released Parties from claims that legally belong to me for injury, disability, death, property damage or loss, medical expenses, lost income and related damages arising from my participation in the Adventure, including claims caused in whole or in part by a Released Party's ordinary negligence.

Covered ordinary negligence includes acts or omissions in adventure design, route selection, directions, warnings, clue or digital-object placement, inspection or maintenance of locations within a Released Party's responsibility, and operation of the adventure or its technology.

This release does not cover gross negligence, reckless or willful misconduct, fraud, intentional injury, a violation of law or any other claim that cannot lawfully be released.

Every release under this Agreement is limited to claims that legally belong to the adult signer and that the signer has authority to release. The foregoing exclusions apply to each release in this Agreement.

7 Parent or Legal Guardian Consent and Personal Release

When I execute this Agreement as a parent or legal guardian, I confirm that I am the parent or legal guardian of the minor identified in connection with my execution of this Agreement and have authority to consent to that minor's participation.

I have reviewed this Agreement and the Adventure's notices, including its transportation risks and safety requirements, and consent to the minor's participation in the Adventure. This consent includes a delayed start or a pause and continuation of the same participation on a different date. I shall explain the safety requirements and arrange supervision appropriate to the minor's age, abilities, route and conditions. The Company does not provide childcare or live supervision.

A child under thirteen may participate only in the presence of a parent, legal guardian or responsible adult authorized by the parent or legal guardian. The accompanying adult shall operate the device used for the Adventure, control access and permissions associated with its use, and remain responsible for the child's safety. A child under thirteen shall not establish an independent account, use the service independently or provide personal information directly through the service.

Participants aged thirteen through seventeen must have parental or legal guardian consent, including when an adult is not physically present. Supervision by another responsible adult does not replace the required execution of this Agreement by a parent or legal guardian.

To the fullest extent permitted by law, I hereby release the Released Parties from all claims that legally belong to me personally arising from the identified minor's participation in the Adventure, including claims caused in whole or in part by a Released Party's ordinary negligence in the activities described in Sections 3 through 6. I waive my right to assert those covered claims.

This personal release includes my own claims for expenses, loss of services and related damages, only to the extent I legally own and may release them. It is subject to every limitation and exclusion in Section 6.

If I also participate in the Adventure, I must separately execute this Agreement in my capacity as an adult participant. Execution as a parent or legal guardian does not constitute my acceptance as an adult participant.

8 Electronic Execution and Privacy

I represent that I am at least eighteen years of age and have legal capacity to enter into this Agreement in the capacity in which I sign. I shall sign personally and accurately identify myself and, where applicable, the minor for whom I give consent.

I consent to the use of electronic records and signatures and intend my electronic signature and affirmative acceptance of this Agreement to bind me in the capacity in which I sign. This Agreement becomes binding on me when I sign. The date and time of execution are recorded with my signature.

Personal information collected in connection with this Agreement is handled in accordance with the Company's Privacy Policy. Execution of this Agreement does not constitute consent to marketing, optional analytics or advertising, or authorize marketing use of crew photographs.

9 General Provisions and Acknowledgment

Nothing in this Agreement waives a right or obligation that applicable law does not permit the parties to waive. If a provision is unenforceable, the remaining provisions continue only to the extent permitted by law. Severance of a provision shall not enlarge a release. An amendment does not retroactively alter an Agreement previously executed.

By signing, I acknowledge that I have had an opportunity to read this Agreement, understand its release of covered claims and voluntarily accept its terms in the capacity in which I sign.
